Summary of CM's submissions on the Charge / evidence The Panel reviewed an incident which occurred in approximately the 54th minute of the Match. In the Panel’s opinion you became involved in a confrontation with an opponent and struck an opponent. You were temporarily dismissed from the field following the incident. The Panel believed that this behaviour was misconduct and against the spirit of the game. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade B offence (Strikes – Punching). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is a 1 to 2 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable.

Player pleads guilty to throwing a punch but argues it was due to provocation. Did not throw multiple punches. Was taken away from initial melee but concedes did go back in but did not throw any additional punches. Opponent was aggressor.

Reasons for Decision The tribunal have carefully watched the DVD and are satisfied this player only appears to throw one punch in reacting to aggression from an opponent. Unfortunately a melee follows when the player is pushed out by an opponent. The player can then be clearly seen running back in towards an opponent. Fortunately he does not throw any additional punches. The tribunal note this player has a previous recent record for this type of offence. In deciding the appropriate sanction the tribunal take into account his acceptance of guilt and the impressive way he has conducted himself during the hearing and his remorse shown. On this occasion the tribunal feel that a 1 match suspension is the appropriate sanction together with a £25 fine. This player must learn and note that type of conduct will not be accepted and if he returns for similar offences he can expect a more serious sanction.
