Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 30th September 2013, you are charged with misconduct for a breach of Law 15.1(i) during the above Match. The Panel reviewed an incident which occurred in approximately the 48th minute of the above Match. This incident was placed ‘On Report’ by the Match Referee. The Panel considered that in completing a tackle that you unnecessarily and forcefully applied undue pressure to the arm/shoulder of an opposing player (Green). As a defender you have a special duty to avoid such contact and the Panel deemed that your actions were against the spirit of the game and involved an unacceptable risk of injury to your opponent. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade B offence (Defender uses any part of his body forcefully to twist, bend or otherwise apply pressure to the limb or limbs of an opposing player in a way that involves an unacceptable risk of injury to that player.) If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from a 1 match to a 2 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable. Under the RFL Disciplinary Guidelines you are not eligible to take an Early Guilty Plea due to your previous disciplinary record.

Summary of CM's submissions on the appropriate sanction The MRP is concerned by the manner in which the player takes hold of the opposing players arm. The panel believes the player attempts to throw the player on his back in a manner that carries an unacceptable risk of injury to the opposing player. Although the panel do not believe there is a deliberate attempt to cause injury to the opposing player, the player is clearly in a deal of pain after the tackle is made.
Summary of Player's submissions on the appropriate sanction Brian McDermott agrees that Danny McGuire puts the opposing player’s arm in a position that could cause pain, and understands why the player has been charged. He agrees that the tackle was not pre-mediated and there was no intent to cause an injury.
