Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 9th September 2013, you are charged with misconduct for a breach of Law 15.1(a) during the above Match. The Panel reviewed an incident which occurred in approximately the 31st minute of the above Match. In the Panel’s opinion you became involved in a confrontation with an opponent and struck out towards him in a violent manner. The Panel believed that this behaviour was misconduct and against the spirit of the game. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade A offence (Strikes – Other Striking Offence). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from no further action to a 1 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable.
Summary of Player's submissions on the Charge / evidence Player represented by Daryl Powell on the phone. There was some provocation from Ben Cockayne which Mr Hauraki does unfortunately respond to. It is accepted that Mr Hauraki should not have done what he did and despite receiving further punches he does not react and inflame the situation further. He did not punch; it was an open handed strike.

Reasons for Decision We have carefully considered everything Mr Powell has said to us. We are concerned that this is the second time this season he has been involved in a fighting offence. However we have decided that there should not be a suspension in this case however a fine of £300 will be imposed. Had it been a punch or followed up by further action then a suspension may have followed.
