Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 21 July 2013, you are charged with misconduct for a breach of Law 15.1(a) during the above Match. The Panel reviewed an incident which occurred in the 78th minute of the Match. This incident was placed ‘On Report’ by the Match Referee. In the Panel’s opinion you became involved in a confrontation between opponents and threw punches. The Panel believed that this behaviour was misconduct, against the spirit of the game, and that your conduct contributed an unsightly melee occurring. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade A offence (Strikes – Punching – Reaction to Opponent). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from no further action to a 1 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable. Under the RFL Disciplinary Guidelines you are ineligible to take an Early Guilty Plea due to your previous disciplinary record.

Player accepts he has thrown punches during the incident, but believes these were only in self-defense. Representative believes player shows a great deal of restraint based on aggression of Catalans player.

Summary of CM's submissions on the appropriate sanction Player committed a tackle that provoked an aggressive reaction from Catalans player. Player was punched by Catalans player and reacts to initial provocation. The player then continues to throw punches beyond what the CM considers self-defence.

Mitigating Factors
Reasons for Decision Although it is accepted penalty was sufficient for initial late challenge, the Panel believe the late challenge played a part in the start of the melee. Although player reacts to a punch from a Catalans player the player does throw punches back. The player also has previous history of fighting and has already taken an early guilty plea this season for such an offence.
