Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 11 July 2013, you are charged with misconduct for a breach of Law 15.1(a) during the above Match. The Panel reviewed an incident which occurred The Panel first reviewed an incident which occurred in approximately the 73rd minute of the Match. In the Panel’s opinion you kicked your opponent in the body after a try had been scored. The Panel believed this was conduct was unnecessary and against the spirit of the game In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade B offence (Strikes – Kicks – Kicks Body – Light Contact). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from a 1 to a 2 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable. Under the RFL Disciplinary Guidelines you are not eligible to take an Early Guilty Plea due to your previous disciplinary record.

Reasons for Decision The tribunal have watched the DVD on several occasions and are satisfied this was an act of petulance by this player towards an opponent who was on the ground. He can be clearly seen to kick out in an instant reaction to having his leg being held by the opponent. The tribunal are satisfied that misconduct is made out in that the player kicks body of the opponent.

Reasons for Decision The tribunal again are concerned that neither the player or the club indicated they accepted these allegations. The players actions are quite clear. It was an instant reaction where no apparent serious injury was caused. However the tribunal note this player has been subject of previous discipline within the last 12 months. Taking into account all the circumstances this tribunal feel that a 1match suspension and £25 fine is appropriate
