Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 13 June 2013, you are charged with misconduct for a breach of Law 15.1(a) during the above Match. The Panel reviewed an incident which occurred in approximately the 55th minute of the Match. You were dismissed from the field of play following this incident. In the Panel’s opinion you kicked out at opponent after being tackled and then threw punches at same opponent in a violent manner. The Panel believed this was serious misconduct; against the spirit of the game and that and that your actions had the potential to cause serious injury. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade D offence; Strikes (Strikes – Other Strikes). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from 3 to a 5 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable. Under the RFL Disciplinary Guidelines you are not eligible to take the Early Guilty Plea due to the grading of the Charge.

Reasons for Decision The committee have viewed this incident and it is clearly an unprovoked attack from what they can see on the DVD. The player has clearly kicked out at his opponent and then proceeded to rain down punches. The player has accepted his guilt of sorts via email and he does have a clean record albeit it is his first season as a professional. The committee feel that in this instance a 4 match suspension and a £25 fine.
