Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 13 May 2013, you are charged with misconduct for a breach of Law 15.1(a) during the above Match. The Panel reviewed an incident which occurred in approximately the 44th minute of the Match. In the Panel’s opinion you became involved in a confrontation with an opponent and threw punches in a violent manner. The Panel believed that this behaviour was misconduct, against the spirit of the game, and that your punches had the potential to cause injury. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade A offence (Strikes – Punching). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from no further action to a 1 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable. Under the RFL Disciplinary Guidelines you are not eligible to take the Early Guilty Plea due to your previous disciplinary record.
Summary of Player's submissions on the Charge / evidence Player accompanied by Head Coach Brian McDermott. Player pleads guilty. The player reacts to being kneed in the head by the opponent whilst he was on the ground. He gets up and initially gets hold of the opponent and then throws punches which are not the hardest punches that have been thrown on a rugby field. I would question the strength of those punches as being capable of causing injury to the opponent and they were not thrown in a violent manner as described in the charge. Coach does not condone reaction by player but there was some provocation in this instance.

Reasons for Decision The tribunal have carefully watched the DVD and the additional DVD provided by the player and coach. This DVD shows that something happened whilst both players were on the ground where it appears the player did receive a knee to his head and retaliated. The tribunal cannot condone retaliation. In deciding the appropriate sanction the tribunal take into account the players plea of guilt and the fact that although he has a previous history he does not have any similar for punching. Taking into account all the surrounding circumstances the tribunal feel that a £300 fine is appropriate and a warning to the player that reactions of this nature in the future may be dealt with in a more severe manner.
