Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on 22 April 2013, you are charged with misconduct for a breach of Law 15.1(a) during the above Match. The Panel reviewed an incident which occurred in approximately the 26th minute of the Match. You were dismissed from the field of play by the match referee following the incident. In the Panel’s opinion when attempting a tackle you made contact with the head of a Hunslet player with your upper arm/shoulder. The Panel deemed this contact to be reckless with the potential to cause your opponent injury. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such offence is a Grade B offence (Strikes with hand arm or shoulder - Reckless). If found to have committed the offence, again in accordance with the On Field Sentencing Guidelines, the normal suspension range for such offence is from a 1 to a 2 match suspension. In addition the Tribunal has the power to impose such fine as it considers reasonable. Under the RFL Disciplinary Guidelines you are eligible to take an Early Guilty Plea due to your previous disciplinary record. If you wish to take this option you will receive a 1 match suspension from midnight on Tuesday 23 April 2013. Summary of Player's submissions on the Charge / evidence David Waite speaking on behalf of the player states that the player is not guilty. Mr Waite feels that the footage is inconclusive. The opponent was falling in the tackle and while the player was travelling at speed and that the point of contact is with the upper arm or shoulder. The player adds that with these outcomes in place and the momentum generated he was always going to go over the top of his opponent. The player feels that there was no contact with the player’s head from the player’s arm or shoulder and he may have grazed him with a chest. There was no shoulder charge in this instance.

Reasons for Decision The committee have viewed this incident carefully. This charge was a brought as a reckless strike to the head using the shoulder/upper arm. The committee are satisfied that the technique used was one of a legitimate nature and that the change in the opponents body position in such a quick space of time contributed to the end result and was through no fault of the player making the tackle.
